First Generation in the New World

1. ALEXANDER¹ MAXEY, was born, presumably in Scotland about 1633 and died at Wenham, Massachusetts in 1684 and his will probate date was 24 June 1684. He married about 1660, in Wenham, to MARY/MARAH ABBE, b. in Salem Village (now Danvers) in 1642; d. in Wenham 2 May 1721, dau. of John and Mary (Loringe) Abbe. 7 8 9 10 11 (SEE IMAGE ON PAGE 2)

Biographical Notes:
(Not the same as Alexander Maxwell, #59, of York County, Maine)
Alexander Maxey was one of four men sent to Wenham and was indentured for a short time to Richard Kimball. He was deposed March 1656 at an Ipswich court concerning a lawsuit by Henry Kimball, his master, versus Thomas Smith, William Marchent, Richard Shatswell and John Newman for damage to corn caused by cattle. Alexander stated that Kimball’s outside fence was a sufficient fence when the damage had occurred. 12  By 1660 he was married and was living Wenham, “where his wife, Mary, and his children became church members, although Alexander apparently did not join.” Reinforcing this date of his appearance in Wenham is his mention as being a settler of the town in 1659 in the  History of Essex County, Massachusetts, With Biographical Sketches of Many of Its Pioneers and Prominent Men. 13 14 He was closely associated with other Scots in Wenham, including as a legatee of Alexander Braband, who died 22 Oct 1678 and bequeathed to Alexander Maxey “a Jacket & a paire of Britches, being all prized at 19s.”15 16 14
On 23 October 1668, Alexander Maxey was mentioned at a Wenham Town meeting, “Richard Huttn & John Clarke is Chosen to Joyne with the Select men to make our ministers Rate for this Instant yeere & to proportion to every man his share of wood according to the towns Ingeagment & every person in the towne is to see yt theire due & full proportions be [don] at or before ye last day of the next month upon the forfiture of double the pric or worth of theire said parte: & the said Defect or fines to be added by the Select men to their Rate & John Abey Senir & James Bette & Alexander Maxey is Chosen to see to the wood Caryeing & they are desired to give in an account to the Select men. 17  He was again mentioned at a town meeting 30 March 1669 as being chosen to hold the position of Surveyor, seeing to the repair of all common fences surrounding corn fields. Then, at a Wenham Town meeting on 6 January 1672 or 73, the following is recorded, “Its granted to Goodman Maxey twenty Akres of lands in our Comon to be layd out to him at the Discretion of the Select men Walter Fairefield & Richard Huttn upon the tenr as followeth viz: for his owne use to Dwell upon alwayes provided that when he or his wife & children shall leave it it shall Returne to the towne to be at theire disposeing.” 18  It is worth noting that on 27 May 1673, a summons to appear in Court concerning trouble at Alexander’s home was recorded “… to summons Abraham Martin to answer his presentment for abusing Alexander Maxe at his own house and also his family, and for taking the Lord’s name in vain, with said Maxe and his wife as witnesses.” 19
There are several land disputes between various parties, some of which involved Alexander Maxey. In one, taking place at Salem Court, 5 June 1678 addressed if Daniel Killam had title to  land which he had sold to Alexander. “Alexander Maxey, aged about forty-five years, testified / that the pasture or close fenced in on the east side of the country road from Walter Fayerfeld=s house and nearly north from the acre of land that Daniell Killam sold deponent, was fenced in by Capt. Thomas Fisk about eleven or twelve years since, all of which time he had improved it for corn and mowing ground. . . .” 20 Then 24 June 1679 at Salem Quarterly Court, Alexander was deposed concerning a land dispute between executor for Samuel Smith versus Richard Hutten. “Alexander Maxey, aged about forty-five years, deposed that he lived about nineteen years on the farm that Mr. William Browne, sr., of Salem had the disposing of, which is said to be the land that was Mr. Samuell Smith’s, and in that part of it was that formerly James Smith’s. The meadow that lay by the river was part of that meadow or swamp that is called the Beaver Hole meadow, which meadow he had enjoyed with John Killam until about nine years ago. Richard Hutten desired deponent to allow him to mow the meadow and he would pay him, but after he let him have it, deponent said he would mow it himself, whereupon Hutten told him not to meddle with it for he had possession of it. The land is bounded on the east with the river, on the north with a little brook between Walter Fairefeild’s meadow and the land itself, on the south with the upland and on the west with Bever hole.” The verdict was in Hutten’s favor.21 After his death, the inventory of the estate of “Alexander Maxy [Maxey], of Wenham, taken 21st of 4th mo., 1684, by Richard Hutton and Walter Fairfield. Amount £159 10s 00d, and administration of the estate granted unto Mary the relict of the deceased, in court, at Salem, June 24th, 1684.” 22
Alexander Maxey’s widow, Mary (Abbe) Maxey, remarried after his death to Corporal Daniel Kilham about 1695, she becoming his 3rd wife. This may have been the same Daniel Kilham mentioned in a court dispute dated 25 June 1678, above. Mary (Abbe) Maxey Kilham died 7 Sept 1696. 23 Worth noting: Mary/Marah Abbe was the sister of Samuel Abbe. Samuel Abbe married Mary Knowlton. Mary Knowlton had a brother, Benjamin Knowlton. He had a daughter, Sarah Knowlton who married Jonathan Taylor, the son of James Taylor, #32 on the “Scots at Lynn 1653. Iron Works Inventory.”
